License A - The Media Producer License

The blanket "media producer license" covers any usage in which you, the purchaser are combining the music with graphics, video, or sound elements to create any media product/ production that is clear and distinct from the music itself. This includes content for tv, film, web, multimedia, podcasting, radio shows, embedding in video games and most other applications. You can use it over and over, in as many projects as you see fit, for life. This is the default license when you purchase music from Stockmusic.net.

The Media Producer License includes:

1. Mechanical rights

The right to re-record, duplicate and release the music as part of your production in whatever medium you choose (i.e. video tape, film, CD ROM, DVD, digital formats).

2. Synchronization rights

The right to use the music as a soundtrack "synced" with visual images, or sounds as part of your production.

3. Public Performance rights

The right to use the music as part of the public viewing or broadcast of your production (including but not limited to tv shows, videos, dvds, web sites, podcasts, multimedia presentations, and films).

Note: A producer generally does not have to pay any performance royalties to organizations such as ASCAP, BMI and SOCAN, but they are expected to include cue sheet information with their production. GUARANTEE

Stockmusic.net guarantees that it owns and controls the rights represented herein with respect to the recordings and the musical compositions in each of the Represented Tracks and has and will hold throughout the Territory and during the Term the above listed rights to exploit the Represented Tracks as contemplated herein . Licensor shall indemnify and hold Licensee harmless from any and all claims, liabilities and costs, losses, damages or expenses (including reasonable attorney’s fees) arising out of any breach or failure of any covenants or warranties made by Licensor herein.

YOU THE PURCHASER MAY:

1. Use the music without restriction for the lifetime of the purchaser, within different or various works or projects as you see fit.
2. Broadcast the music (as part of your production) over any public or private medium that complies with FCC guidelines.
3. Transfer the music to any medium necessary (video, film, reel to reel, digital, etc.) to complete your production and distribution of your project.
4. For audio-only projects you must voice over the music in intervals of 30 seconds or less, or combine the music with other audio elements so that your production is "substantially different" from the music itself. If you have any questions about your particular usage please contact us.
5. Use the music themes for any visual productions (film, video, etc.) in their entire length and these productions may be duplicated without restriction.

LIMITATIONS

The Represented Tracks may not be resold as part of other music or audio-related collections, in part or in whole. They may not be used or resold as a commodity except as part of a media production that is clearly unique and distinct from the track itself. Tracks may not be copied or duplicated except for use in the licensee's productions and must only be used by the person to whom the license was given. Tracks may not be traded or exploited for profit or any other reason. Digital Sound Media maintains all intellectual property rights with regard to the marketing and sales of all tracks and any infringement thereof is punishable by law.

YOU THE PURCHASER MAY NOT:

1. Re-record or change the music in any way without the written consent of the owners. (You may, however, edit the music to fit your needs.)
2. Claim ownership or authorship of the music represented under this agreement.
3. Transfer, share or sub-lease this license agreement with any other party.
4. Sell the music contained herein outright to any other individual or party. (Although the music can be sold as part of your production.)

TERM

This license agreement is effective for the lifetime of the purchaser.

TERRITORY

The world.

This is a legal agreement between you, the end user, and Digital Sound Media/ Stockmusic.net, a division of REM Publishing LTD. Purchasing and use of any track or tracks from Stockmusic.net constitutes acceptance of these terms.

License B - Public Performance License

The "public performance license" allows use of the music for on hold/ background music, music in an office, restaurant, retail environments, institutions or other public places. This option is available at checkout only when you purchase music from the "on hold" or "retail/ restaurant" sections of the site. You pay once for the music, and can use it forever as an on hold message, or as background music in a public location. You will never have to pay anything to organizations such as ASCAP, BMI etc. because at Stockmusic.net we split the license fees with the composers directly.

Custom licensing

Custom licensing is available for projects that do not fit either of the above categories. Some examples of custom licensing would be:

1. if you want to duplicate one of the collections at Stockmusic.net and give it away as a gifts to employees at Christmas
2. you want to create a relaxation CD and give it away as part of a spa retreat package
3. you are creating a website, or hardware device which will allow your customers to download or access free music tracks
4. you want to broadcast the music on its own (not as a part of a unique production)
